Ignition Interlock Devices Will Be Required for Participants in DUI Pre-trial Diversion Programs

On July 1, 2018, Alabama’s new DUI law went into effect. Under the current DUI law, drivers charged with DUI and who participate in a DUI pre-trial diversion program are not required to install an ignition interlock device in their vehicle. After July 1, 2018, however, all participants in DUI pre-trial diversion will be required to install an ignition interlock device.

Interlock ignition devices are breathalyzers that are incorporated into the vehicle’s ignition system. If the interlock ignition device detects alcohol, it will not allow the car to start. Interlock ignition devices also tracks the number of times it detects the presence of alcohol. If the ignition interlock device records more than four or more samples at or above 0.02% BAC, the mandated period for the use of the ignition interlock device will be extended.
